. >> i just have to repeat, congress, you are terrible at your jobs. i really don't like working with you. we're going to talk a bit later in the show about everybody hates congress and what we can do about that. but as much as the public hates congress, you really get the feeling that congress' approval rating among president obama is in the neighborhood of negative 75,000 percent. and yes, numbers geeks, not a real number. but he seems really tired of working with these people. but there is a way in which congress, and particularly congressional republicans may actually be helping president obama out right now. everybody's always known two things about the cliff. you're almost certainly going to get more taxes in a deal after you go over than in a deal before you go over it. that's because after you go over the cliff, taxes already go up for everybody. so anything you do, any reasonable deal congress reaches, it will be a big tax cut. but the other thing about the fiscal cliff is you don't want to be blamed for going over it. it is going to be bad for the economy. it's bad for the count

this is a process. obviously, there's a lot of give and take going on now, but republicans don't want to see new revenues, in other words, democrat tax increases, be used for new spending. so that's sort of where many of our members have drawn the line now. >> that is where it times to be one of the big road blocks are right now, democrats -- you-all want to use what's known as chained cpi, which is a technical -- i won't get into it now but would effectively really affect social security recipients to replace the sequester, which is $100 billion in cuts and democrats want to use new revenue from tax increases to replace the sequester. is that where you see it? >> yeah, there are other issues involved but that's certainly one example of one where -- frankly, chained cpi, us to is not just about replace the sequester today it is putting in place a policy that will help save and protect social security in the long term. but that being said, if democrats don't accept that as an offset, then come up with something else because raising taxes to pay for new spending is not going that republicans belie

to get this stuff done, not because democrats in congress don't want to go ahead and cooperate, but because i think it's been very hard for speaker boehner and republican leader mcconnell to accept the fact that taxes on the wealthiest americans should go up a little bit as part of an overall deficit reduction package. the offers that i've made to them have been so fair that a lot of democrats are getting mad at me. i mean, i offered to make some significant changes to our entitlement programs in order to reduce the deficit. they say that their biggest priority is making sure that we deal with the deficit in a serious way, but the way they're behaving is that their only priority is making sure that tax breaks for the wealthiest americans are protected. >> fiscal cliff negotiations are now down to the wire with a midnight deadline just hours away. that's tonight, new year's eve. at stake, the prospect of sweeping tax hikes and across-the-board spending cuts if a deal is not reached. and all indications are it's not looking good. here's the latest. the senate is scheduled to reco

there are crews on the scene already cleaning up and they have a lot of cleanup to do. right now they don't know how much this is going to cost them to fix up. initial reports right now all but one of the portable classrooms completely destroyed, many of these sticks and splinters you see behind me are what they are now. also the roof of the band hall literally picked up and moved. you can see the sky now and as far as the athletic facility several windows have blown out. the school was built back in the 1920s and one of the largest in alabama with 2,000 students. they're in a rush to get everything back open january 3rd. as far as the rest of mobile they saw damage in other areas as far as houses, a church was damaged as well as the infirmary. there are no reports of injuries or anyone killed. reporting live, christina leavenworth, back to you. >> thanks so much. it's the east coast's turn as the heavy snow seen here in seymour, indiana, is expected to make its way to the ohio valley and further east. these are taped pictures but not taken too long ago. you see the reporter there. blizzard warn

of the tornadoes and the snow today we had a repeat of it. the tornado threat i don't think as big as yesterday but it is still there. further off toward the east as the line right here continues to push off toward the east. it is very unstable ahead of it. i will show you that throeat ina second. the blizzard going on near the ohio and mississippi river right there south of paduka. that's the bulls eye. it will continue to go off to the northeast. anywhere you see this yellow from parts of virginia to central florida could see windy conditions. we could see tornadoes. i think the bullseye of tornadoes is where this moderate risk is across south and north carolina. that will be later on this afternoon. we have blizzard warnings in effect. darker red is blizzards reduce visibility quarter of a mile. 3-6 inches in additional snow around the ped duaducah area. the bullseye will be well over a foot. coastal areas mostly rain. start with a little snow transitioning over to rain. you will be dealing with a lot of snow this evening and all day tomorrow. guys? >> rick, thank you very much. you have bee

very, very difficult to get any kind of agreement in this congress. i don't mean just the last few days but in this congress, unfortunately. but giving up is not an option for us. we have another 13 hours as has been pointed out if we can reach agreement, if we can have a unanimous consent in the senate i think there is still time to act but of course it's running out very, very quickly. >> how is the mood? do you feel good about this? or do you believe we'll go over the cliff here? >> well, i'm still hopeful. while we're here all the members are in washington, ready to act. the issue is whether or not we can come to a consensus. the administration in my opinion continues to try to make offers that will get to an agreement. unfortunately, as was pointed out in your earlier report, even a million dollars seemed unacceptable to the republican conference just a few days ago. the president is not going to go there. we're not going to go there. the american people don't think we ought to go there. what the american people want to make sure is that working americans, middle class americans, d

in which many don't know and can't figure out whether they can rely on the fourth amendment to protect sensitive information that they routinely share with others for a limited business purpose. congress needs to act to preserve the fourth amendment's protections as they apply to everyday uses including routine use of the internet, use of credit cards, libraries and banks. absent such protections, individuals may in time grow weary of sharing information with third parties. i'm cognizant that this area of the law is complex. it's full of changes and full of instances in which we have to undertake a very delicate balancing act. nevertheless, much work remains to be done to ensure that the fourth amendment protections are here and that they are real and that they benefit americans and that they do so in a way that doesn't interfere with legitimate law enforcement and national security activities. we must not shy away from the task simply because it is hard. it is daunting, but it is possible and it is necessary. congress must act to preserve americans' constitutional right to be secure i
